Request for Excuse

Please refer to your summons for detailed instructions. All requests for excuse from jury duty must be submitted in writing. Please read your summons carefully to determine deadlines for your written request to be received. Most will have to be submitted no later than one (1) week prior to your scheduled report date. All requests for excuse will be reviewed on an individual basis. Please be specific in your written request and provide ALL the pertinent information we need to make an informed decision about your particular situation.

You may submit your request for excusal by mail to: Miami County Municipal Court, 215 W. Main Street Troy, Ohio 45373.

Please note: Postponing jury service is preferred to excusing a prospective juror. Inconvenience to a prospective juror or employer is not an adequate reason to be excused from jury duty. In many cases, your request to be excused may be denied and a new report date given so that there is additional time to plan for your term of service.

Excusals may be granted for the following but the request should be supported by facts and/or appropriate documentation as outlined below:

(1) The prospective juror has a serious physical or mental condition and the jury service would expose him/her to undue risk of physical or mental hardship. NOTE: If the juror is under 75 years old, he/she must request a Physician's excuse. 

Request for Postponement

If the report date that you have been assigned creates a serious conflict with your schedule, you may request to have your service postponed.** Please refer to REQUESTS FOR EXCUSE in your summons for detailed instructions. All requests for postponement must be submitted in writing. Please read your summons carefully to determine deadlines for your written request to be received. Most will have to be submitted no later than one (1) week prior to your scheduled report date. We will be happy to grant your request for a postponement, but would like to make you aware of our policy on rescheduling your service.


· Your jury duty may only be rescheduled one time.

· You must choose a specific date in your written request for postponement.

· You may select, as an alternative report date, as long as it is within 3 months of the
original summons date.

When requesting your postponement date, please provide a 1st and 2nd choice of dates. In most cases, your 1st choice of dates will be acceptable. Please be sure to clear the date you have selected with your calendar as well as your employer's (if applicable.) You will receive written confirmation by mail that your service has been rescheduled. Please mark your calendar accordingly and notify your employer (if applicable) of your new report date. A new summons will be sent to you approximately 30 days prior to your new report date.
